Does a Police Report Affect a Wrongful Death Lawsuit in Pennsylvania?

A police report is a critical document when pursuing a wrongful death claim following a fatal car accident. Official reports provide an objective record of the incident and can serve as crucial evidence for legal proceedings and insurance purposes.

Here’s how a police report can impact a wrongful death case:

  1. Documenting Accident Circumstances
Police reports typically detail vehicle positions, point of impact, traffic violations, witness statements, and other relevant information. This documentation helps establish the sequence of events and identify potential liability.

  2. Supporting Legal Claims
In a wrongful death lawsuit, a police report can corroborate claims of negligence or fault. Courts and insurance companies often rely on these reports to assess responsibility and damages.

  3. Correlating With Medical Evidence
While the accident is fatal, reports can support related evidence such as emergency response records, autopsy findings, and other official documentation linking the crash to the cause of death.

  4. Providing Contact Information for Investigation
Police reports list the investigating officers’ names and contact details, which are essential for follow-ups or clarifying details relevant to legal claims.

Maintaining a copy of the police report, along with any photos, witness statements, or official documentation, helps families preserve crucial evidence. Consulting a qualified wrongful death accident attorney ensures that families understand how to use this information effectively and protect their legal rights.
