How Long Do Families Have to File a Wrongful Death Claim in Pennsylvania?

In Pennsylvania, families generally have two years from the date of a loved one’s death to file a wrongful death claim, although certain circumstances may affect the deadline.

Because these legal time limits can determine whether a claim may proceed, it is important to begin gathering information and reviewing available options as early as possible.

Police reports, medical records, witness statements, photographs, vehicle information, and other documentation may become valuable when reviewing how the crash occurred and evaluating potential claims. Preserving this information early can help provide a more complete understanding of the events leading to the loss.

Families may also need time to organize financial records connected to the death, including medical expenses incurred before death, funeral costs, loss of financial support, insurance communications, and other related expenses.

Keeping these documents together may help provide a clearer picture of the losses associated with the fatal accident and support any future claim. These records may also help when communicating with insurance companies or reviewing available options.

Although Pennsylvania law establishes filing deadlines, certain circumstances may affect how those deadlines apply.

Reviewing the facts of the case early may help families better understand the applicable time limits and avoid unnecessary delays while important evidence is still available. Early legal review may also help identify additional documentation that could be relevant to the claim.

A lawyer familiar with Pennsylvania law can review the circumstances of a fatal crash, explain the filing deadlines that may apply to a wrongful death claim, and discuss possible legal options based on the available facts.

Legal guidance may also assist with reviewing documentation, communicating with insurance providers, preserving important records, and evaluating whether additional steps may be appropriate.
