A second victim has died following a tragic three-vehicle collision on the Liberty Bridge that occurred on Sunday, March 1. The Allegheny County Medical Examiner’s Office confirmed on Thursday, March 5, that 28-year-old Jaren Wilkerson of Duquesne passed away at a local hospital on Wednesday, March 4, more than 72 hours after the accident.
As a result of the accident, Laila Jones, 25, of Baldwin, was pronounced dead at the scene shortly after the collision at 1:00 a.m. The accident involved three vehicles, one of which became engulfed in flames, trapping the three occupants inside
First responders extinguished the fire and managed to extricate two individuals, though both were initially listed in critical condition. A third person remains hospitalized as they continue to recover from injuries sustained in the wreck.
Local authorities remain actively engaged in reconstructing the incident to determine the sequence of events that led to the accident.
Our heartfelt condolences go out to the loved ones of Jaren Wilkerson and Laila Jones during this challenging time. And we wish a full recovery for the person who remains hospitalized.
In Pennsylvania, when a fatality occurs due to another party's negligence, the legal system provides two distinct but complementary avenues for recovery: the Wrongful Death Action and the Survival Action.
These claims are frequently filed together in a single lawsuit to ensure that both the surviving family members and the deceased's estate are comprehensively compensated for their losses.
The Wrongful Death Action is specifically designed to compensate the surviving spouse, children, and parents for the personal losses they suffer as a result of their loved one's passing. This claim focuses on the future financial and emotional stability of the family.
Recoverable damages in this category include funeral and burial expenses, the loss of financial support the deceased would have provided, the value of lost household services, and compensation for the loss of companionship, comfort, and guidance.
In contrast, the Survival Action functions by allowing the personal representative of the estate to effectively step into the shoes of the deceased to pursue the claims the individual could have brought had they survived the accident. This action compensates the estate for the losses the decedent suffered from the moment of injury until their death.
Damages under a survival action include medical bills incurred before death, pre-death lost wages, and compensation for the physical and emotional pain and suffering experienced by the victim.
