Early this morning, five people sustained serious injuries in a Southwest Philadelphia accident at 26th Street and Passyunk Avenue. This occurred when a car came down onto the highway without stopping, where it slammed into a minivan with five others inside. Two people were taken to a medical center, and three others were taken to a hospital for injuries, but we have not received an update on their conditions at this time.

When a Driver Has Acted Negligently

Southwest Philadelphia accidentJust as in the Southwest Philadelphia accident, there are many accidents every day where drivers do not pay attention to what goes on around them, which leads to negligence. Negligence occurs when the defendant in an accident failed to abide by the duty of care to keep you and others safe from harm on the roadways. This can happen for many reasons, such as those who choose to drink and drive, those who drive distracted, and many other reasons.

If you can show that a driver was acting negligently and did not abide by the rules of the road, you may be able to obtain damages in the accident case. It is clear that, in the Southwest Philadelphia accident, the driver was not paying attention to the roadways, but many other types of negligence might have been taking place as well.
